Article 1: General provisions The e-commerce website "MVCWceramics" , company with VAT BE 0708.760.093, (hereinafter 'Webshop MVCWceramics') offers its customers the opportunity to purchase the products from its webshop online. These General Terms and Conditions ("Terms and Conditions") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order via the webshop 'Webshop MVCWceramics', the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, unless they have been previously, in writing and expressly accepted by 'Webshop MVCWceramics'.
Article 2: Price All prices stated are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer. Delivery, reservation or administrative costs may be charged; these are stated during the ordering procedure. The stated price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.
Article 3: Offer Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind 'Webshop MVCWceramics'. Webshop MVCWceramics' is only bound by an obligation of means with regard to the accuracy and completeness of the offered information. Webshop MVCWceramics' shall under no circumstances be liable in the event of manifest material errors, misprints or printing errors. Most of the products offered are handmade. The photos on the website will never correspond 100% with the delivered product.
If the Customer has specific questions about e.g. sizes, colour, availability, delivery period or delivery method, we request the Customer to contact MVCWceramics@gmail.be in advance. The offer is always valid while stocks last and may be amended or withdrawn by 'Webshop MVCWceramics' at any time. 'Webshop MVCWceramics' cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
Article 4: Online purchases Purchases are placed in the shopping cart with the Add to cart button. The contents of the shopping cart can be called up and changed at any time. The Checkout button takes the customer to the purchase summary page. In the Order summary, delivery costs are listed and added. Informatively, the VAT amount is shown. The customer provides his e-mail address for all further communication regarding the status of his delivery. The customer also specifies his delivery address and any billing address. Then the customer can click the Purchase button. The Customer has the choice between the following payment methods - by credit card - by bank card 'Webshop MVCWceramics' is entitled to refuse an order due to a serious fault on the part of the Customer regarding orders involving the Customer.
Article 5: Penalties for non-payment Without prejudice to the exercise of other rights available to 'Webshop MVCWceramics', in the event of non-payment or late payment, the Customer shall be liable, ipso jure and without warning, to pay interest of 10% per annum on the unpaid amount from the date of the default. In addition, the Client shall automatically and without warning owe fixed compensation of 10% on the amount concerned, with a minimum of €25 per invoice. Without prejudice to the above, 'Webshop MVCWceramics' reserves the right to take back items which have not been paid for (in full).
Article 6: Privacy: MVCW ceramics respects the Belgian law of 8 December 1992 on the protection of privacy in the processing of personal data. The personal data communicated by you will only be used for the following purposes: the execution of the concluded agreement, the processing of the order and the follow-up of the payment. You have a legal right to inspect and possibly correct your personal data. Subject to proof of identity (copy of identity card), you can obtain the written communication of your personal data free of charge via a written, dated and signed request to MVCWceramics. If necessary, you can also ask to correct the data that would be incorrect, incomplete or irrelevant. We treat your data as confidential information and will not transfer, rent or sell it to third parties.
Article 7: Use of cookies During a visit to the site, 'cookies' may be placed on the hard disk of your computer. A cookie is a text file placed by a website's server in your computer's browser or on your mobile device when you consult a website. Cookies cannot be used to identify individuals; a cookie can only identify a machine. 'First-party cookies' are technical cookies used by the site visited itself and whose purpose is to make the site function optimally. E.g.: settings made by the user during previous visits to the site, or even : a pre-filled form with data the user has done during previous visits. 'Third Party cookies' are cookies that do not come from the website itself, but rather from third parties, e.g. a marketing or advertising plug-in present. E.g. cookies from Facebook or Google Analytics. Such cookies require the site visitor's prior consent - this can be done via a bar at the bottom or top of the website, referring to this policy, which however does not prevent further browsing of the website]. Article 8: Impairment of validity - non-impairment If any provision of these Terms and Conditions is declared invalid, illegal or null and void, this shall in no way affect the validity, legality and applicability of the other provisions. Failure at any time by 'Webshop MVCWceramics' to enforce any of the rights enumerated in these Terms and Conditions, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of these rights.
Article 9: Amendment of Terms and Conditions These Terms and Conditions are supplemented by other terms and conditions explicitly referred to and the general terms and conditions of sale of 'Webshop MVCWceramics'. In case of conflict, these Terms and Conditions shall prevail.
Article 10: Proof The Customer accepts that electronic communications and backups may serve as proof.
Article 11: Applicable law - Disputes Belgian law shall apply, with the exception of the provisions of international private law on applicable law. The courts of the Consumer's domicile have jurisdiction in the event of legal disputes. The Consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
Shipping & return
Article 1: Delivery and performance of the contract For goods ordered to order, the delivery time is agreed with the customer on a case-by-case basis. Articles ordered via this web shop are only delivered in Belgium. Delivery is made by BPOST. Unless otherwise agreed or expressly stipulated, the goods are delivered to the Customer's place of residence within 30 days of receipt of the order. Any visible damage and/or qualitative deficiency of an article or other shortcoming in the delivery must be reported by the Customer immediately to 'Webshop MVCWceramics' (e-mail to MVCWceramics@gmail.com). The risk due to loss or damage passes to the Customer as soon as he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice had not been offered by 'Webshop MVCWceramics'.
Article 2: Retention of title The goods delivered shall remain the exclusive property of 'Webshop MVCWceramics' until payment in full by the Customer. The Customer undertakes to inform third parties of Webshop MVCWceramics' retention of title if necessary, e.g. to any person who may come to seize goods which have not yet been paid for in full.
Article 3: Right of withdrawal The provisions of this article apply only to Customers who purchase items online from 'Webshop MVCWceramics' in their capacity as consumers. If the right of withdrawal applies: The Customer has the right to withdraw from the contract within a period of 14 calendar days without giving reasons. The withdrawal period shall expire 14 calendar days from the day on which the Customer or a third party indicated by the Customer, other than the carrier, acquires physical possession of the good In order to exercise the right of withdrawal, the Customer must : notify MVCWceramics of his decision to withdraw from the contract by e-mail MVCWceramics@gmail.com and by an unequivocal statement (e.g. in writing by post or e-mail). To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired. The Customer must return or hand over the goods to MVCWceramics without undue delay and in any event not later than 14 calendar days from the day on which he communicates his decision to withdraw to MVCWceramics. The Customer is on time if he returns the goods before the period of 14 calendar days has expired. The direct costs of returning the goods shall be borne by the Customer. The Customer is requested to return the items in their original condition and packaging, with all accessories and instructions supplied with them.
Article 4: Guarantee Under the Act of 21 September 2004 on consumer protection in the sale of consumer goods, consumers have legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights. To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to keep the original packaging of the goods. For items purchased online and delivered to the Customer's home, the Customer must contact 'Webshop MVCWceramics' and return the item to 'Webshop MVCWceramics' at the Customer's expense. Upon discovery of a defect, the Customer must inform 'Webshop MVCWceramics' as soon as possible. In any case, any defect must be reported within a period of 2 months after its discovery by the Customer. Thereafter, any right to repair or replacement shall lapse. The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the user instructions or manual, adjustments or modifications to the article, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, subject to proof to the contrary by the Customer.
